Terms of Service

These Terms of Service ("Terms") govern your use of Cultonomy at cultonomy.com and our related mobile apps and services (the "Service"), operated by Drag The Net Pty Ltd (ABN 41 672 521 032) ("we", "us", "our"). By accessing or using the Service you agree to these Terms.

1. Eligibility and accounts

You must be at least 16 years old to use the Service. You are responsible for the activity on your account and for keeping your credentials secure. You must provide accurate information and keep it up to date.

2. Subscriptions and payments

Some features are offered on a paid or subscription basis. Payments are processed by Stripe. Paid subscriptions renew automatically for the applicable period until cancelled. You can cancel at any time, effective at the end of the current billing period. Except where required by law, payments are non-refundable. Where you sell or receive payments through the Service, you authorise our payment processor to facilitate those transactions, and applicable platform fees will be disclosed at the time.

3. Your content

You retain ownership of the content you submit. You grant us a non-exclusive, worldwide, royalty-free licence to host, store, reproduce and display your content as necessary to operate and promote the Service. You are responsible for your content and must have the rights to share it.

4. Acceptable use

You agree not to use the Service to upload unlawful, infringing, harmful, or misleading content; to harass or harm others; to violate the rights of any third party; or to interfere with the security or operation of the Service. You must comply with the terms of any third-party platform you connect, including Instagram and Facebook.

5. Intellectual property

The Service, including its software, design and trademarks, is owned by Drag The Net Pty Ltd and its licensors and is protected by law. These Terms do not grant you any rights in our intellectual property except as needed to use the Service.

6. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms or where necessary to protect the Service or other users.

7. Disclaimers and limitation of liability

The Service is provided "as is" without warranties of any kind to the extent permitted by law. Nothing in these Terms excludes rights you have under the Australian Consumer Law that cannot lawfully be excluded. To the maximum extent permitted by law, our liability arising out of or in connection with the Service is limited to the amount you paid us in the 12 months before the claim.

8. Governing law

These Terms are governed by the laws of New South Wales, Australia, and you submit to the non-exclusive jurisdiction of the courts of that jurisdiction.

9. Changes to these Terms

We may update these Terms from time to time. We will post the updated version on this page and revise the "Last updated" date above. Your continued use of the Service after changes take effect constitutes acceptance.
